The Chartered Institute for Arbitrators (CIArb) issued the Guideline on Third-Party Funding, which is available here. The Guideline addresses the funding process and issues arising in an arbitration involving a funded party.
Viren Mascarenhas served on the Drafting Committee that issued the Guideline. Viren has significant experience in the third-party funding industry. He has advised and represented parties seeking third-party financing on single cases or in a portfolio of cases. He has also been directly involved in law firm portfolio financing. And he has advised third-party funders on whether to underwrite potential matters, especially in commercial and investment arbitration and enforcement of foreign arbitral awards in U.S. courts and elsewhere. Viren also has experience with insurance products relevant to funding, such as ATE insurance or other products such as Work in Progress (“WIP”) insurance, which may be obtained on their own or in conjunction with third-party funding.
